De acuerdo con algunos tratadistas; la pena de muerte, pena capital o ejecución consiste en provocar la muerte o asesinar a un condenado por parte del Estado, como castigo por un delito establecido en la legislación; los delitos por los cuales se aplica esta sanción suelen denominarse “delitos capitales”. Claro esta que este tipo de prácticas es repudiado por la mayoría de los países en el mundo y más aun ante la falta de credibilidad y profesionalismo de los sistemas de impartición de justicia en los que se pueden verter otros intereses o vicios ocultos. El primer tratado internacional que busco abolirlo fue el del “pacto internacional sobre los derechos civiles y políticos” firmado en 1989 durante la Asamblea General de las Naciones Unidad; firmándola y ratificándola al menos 53 países, contándose con la presencia de Canadá.

Así también durante la convención europea sobre los derechos humanos en 1982, se exigió su abolición durante tiempos de paz; respaldándola mas de 51 países europeos. Para el 2002 el mismo consejo europeo solicito la extinción de la pena de muerte en cualquier circunstancia en tiempos de guerra y de inminente amenaza de la misma. Respaldándola simplemente 37 naciones. Por su parte; en la Asamblea General de la Organización de los Estados Americanos de 1990, se solicita la abolición total de la pena de muerte, sin embargo le permite a los Estados sostenerla en tiempos de guerra y fue respaldada por 8 países. Y fue hasta Septiembre del 2007 que México se integro a estos tratados internacionales; pero claro es que en ninguno de esos tratados figuro el de Estados Unidos.

A pesar de que una de las leyes fundamentales del derecho natural y jurídico de todo ser humano; en todas las constituciones políticas; en todos los idiomas, en todas las razas, religiones e ideologías de las naciones del mundo incluida la estadounidense, así como en la Declaración Universal de Derechos Humanos, adoptada por la Asamblea General de la ONU en diciembre de 1948, se reconoce el derecho de toda persona a la vida. Es mas en su artículo 5, se establece claramente que; –“nadie será sometido a tortura ni a penas o tratos crueles, inhumanos o degradantes”–. Y sin embargo; allí tenemos cárceles de la vergüenza como la de Guantánamo y entidades federativas tales como Arizona o Texas entre otras que conforman a EU son garantes del repudio social por su negativa a respetar la vida. A pesar de ser una nación muy conservadora pero con sus actos demuestra ser una farsante ante su doble moralidad –“amor y preservación por los “seres vivos”; tortura y asesinato para los extranjeros”–.

Hoy México esta de luto nuevamente ante el artero asesinato de Humberto García Leal, quien no conto con el derecho de asistencia consular y ante un proceso judicial viciado y plagado de irregularidades. A esos asesinos no les importo la resolución de la Corte Internacional de Justicia de la Haya y mucho menos que países como Honduras, Brasil, el Salvador y Suiza; así como el Organismo Internacional de los Derechos Humanos, solicitaran la suspensión de aberrante ejecución. Amigos lectores; hasta donde recuerdo, la ley se hizo para prevenir el delito y no para castigarlo. Aunado a ello se hace aberrante que el Estado castigue un delito ejecutando otro delito; convirtiéndose él en delincuente al cometer un crimen. Eso da cavidad a que por cualquier pretexto el Estado te siembre una contravención para que extinga tu vida y la vida de cualquier otro ser humano, tan solo por su mera satisfacción y sin que puedas defenderte.

Estados Unidos nos vio la cara de tontos a todos los latinoamericanos, migrantes, inmigrantes y el resto del mundo; pues sobre su discurso asesina alegando velar por la preservación de la vida humana. Pero lo que realmente oculta con estas palabras es su magnánimo racismo para con los demás. Pues resulta ser que la mayoría de los ejecutados o sentenciados a la pena capital en un 90 por ciento son migrantes. Mientras que por otro lado; los verdaderos criminales, esos que son conciudadanos, sin importarles que sean homicidas seriales; les dan un mejor trato al tener mayores oportunidades de reinserción a la sociedad, de recibir asesoría psicológica y capacitación laboral; es mas, hasta reciben penas mucho más ligeras y sanciones pecuniarias que dan riza. Realmente la pena de muerte no tiene otro propósito que el de asesinar a los ilegales, a pesar de que gracias a ellos Estados Unidos se mueve económicamente hablando. 

Estaríamos de acuerdo en aceptar la pena de muerte pero siempre y cuando el verdugo que blandee la guillotina sobre el criminal, sea una nación o un hombre sin delito alguno. Pero ¿acaso el gobierno estadounidense puede ser considerado como la nación mas pura y casta para desempeñar el papel de verdugo? ¡No es Norteamérica quien ha contaminado nuestras naciones de sus desechos radiactivos o inundado de armas al resto de los países con fines de lucro! ¡No es Estados Unidos quien ha impulsado los conflictos bélicos entre naciones! ¡No es el Estado yanqui quien nos ha bañado de drogas buscando incrementar su producto interno bruto! ¡No es Estados Unidos el que ha cometido espionaje internacional! Si como nación queremos que Estados Unidos y todos aquellos países que practican la pena capital como represión racial respete la vida humana y la de nuestros compatriotas tal ves sería preciso aplicar la pena de muerte a todos los extranjeros que provengan de esas naciones. Muerte a todos los gringos visitantes que comentan algún delito y que no cuenten con familia en el país y sin derecho a un juicio justo. Por que todos somos Humberto García Leal ¡Vivan los mártires del racismo! ¡Vivan los ultimados por Norteamérica!

If we as a nation the United States and those countries that practice capital punishment and racial repression respects human life and our fellow citizens must be implemented as you see the death penalty to all foreigners who come from these countries. Death to all visitors say gringos a crime and not have family in the country and no right to a fair trial. Why are all Humberto Leal García live the martyrs of racism! Vivan los killed by America!
